This topic was created to present the situation and discuss about the fact how it was conducted by GMs. This thread has nothing to do with drama called "gm pro astale" and is based on completely different issue.
I will describe the situation which occured today. I had access (access given personally by the owner of the account) to website account of the player who is no longer playing on this server and as far as is my knowledge he is not coming back. This person told me that I can take his items if he will not log at least for 4 months, because it will mean he will not come back at all. Few days ago (after restart) I logged on his character and send the items to my character as our deal allowed me to. People who know me are aware of the fact that I share items with my clan mates whoever needs my help. So I did after I transfered them on a character, I gave the items I didnt need to clan members in order to help them with their characters. Today I have been jailed by the GM for stealing these items. Right now this situation raises a lot of issues as well as complications of misuse of the power of GM.
According to GM Sekai's post in the Player reports section:
"I'll explain in this thread a bit of what we can and we can not do about stolen items in L2Vanir.
First of all, if you get stolen is your own fault for sharing your account with someone else, we as a staff perspective can't generate new items from nowhere and give them away. If you were stolen and you want to get your items back the only way is that the player who stole them returns them to the owner.
There're many rules that must to be followed, the first is to NOT insult or defame the person who stole the items since it was YOUR own fault and you accepted the chance of being stolen when you shared your account password. If you insult them you're most likely not going to see your items again.
The second thing you should do would be posting screenshots in this forum section and proving that those items were yours, also you should mention who had the items and which were every item and their specifications so we can search who stole them. As GMs we can only ask the player who stole it to return it in a good way.
As it's said before GMs aren't forced to take any responsability on this, since it's the player's fault and we already advise to not share your accounts.
And I will repeat, DO NOT SHARE YOUR ACCOUNTS!"
1.Access to account was given to me.
2. GM can ask to return items in a good way, I believe jail is not a good way.
3. I don't see any post from the owner of the account on the forum stating which items has been 'stolen'.
4. I'm sure the owner of the account didn't report me to GM because he is no longer here. So it had to be claim from the person who IS NOT the owner of the account.
Additionally, I have been told that that jail will last till I return the stolen items, in my humble opinion it is called blackmailing. This is irrational claim since the items have been traded/given/sold. I was asked to provide the proof that owner told me to take these items. This person changed his skype account I have no contact with him, unless he logs into his website account and read private message, it is not currently possible to contact with the owner. Moreover, as far as I'm concerned Jail is the punishment for breaking the rules. None of the rules has been broken. I believe GM refered to the first rule, which states:
While playing L2Vanir, you must respect the rights of others and their rights to play and enjoy the game. To this end, you may not defraud, harass, threaten, or cause distress and/or unwanted attention to other players.
The only reasonable claim is the fact that I might have caused the distress to the owner of the account. However, as I stated above the owner is no longer here and he didn't post/said/wrote anything about this situation. Another aspect is the fact that all the jails should be reported on the forum in the Punishments section, as I can see there is no post about my account. Looking through the history of the forum there is no single thread stating the jail for the player beacuse of the stealing. Why? Because stealing may be only considered IF player use external software to get access to other player's account, stealing is not the case when the owner gave the access personally to another person. Final aspect is that the jail got main character, not the character the items were send, GM reasoned it by saying 'it is preventive jail not to transfer stolen items'. How is that preventive if it is not the character on which the items were send, in my humble opinion it is the action taken to prevent me from enjoying my character and items I made (Elegia weapon +16, made couple of days ago).
Another problem is the fact that as I know GMs should follow the rules of the server as well as players.

My right to enjoy the game has been violated, without the reasonable matter. I have been threaten by the GM, which I mentioned earlier as blackmailing. It also caused a lot of distress to me and my clan members.
I want to provide ridicoulus example just to show the case, this example is very relevant to the situation above:
I claim to have refund on all the donations I have made since they were than unlawfully. Why?
Rules state that:
You may not advertise the intent to or commit the act of buying or selling items or accounts for cash/real world currency.
Donation is based on breaking this rule. Because I buy item in the game (Golden Apiga) by the real life currency(Euro). As I can see Donate section is well advertised and is the violation of the rules provided by the GMs. Like I said it is ridicoulus example but it is relevant to the situaion with me and these items.
By this post I wanted to present how I was treated by GMs, which in my opinion was completely inapporpriate and proves the misuse of their power. Such situation might have occured before and it is highly possible will occur in the future, unless we can inform other players on the server what is done without their knowledge.
I am looking forward your comments about this situation.
